STANDARD TERMS AND CONDITIONS

These terms outline the agreement between the customer and The Ginger Bear Bakery. Your order, the order confirmation, and these terms constitute the complete agreement for the sale of cakes. It is your responsibility to ensure all details in the order confirmation are accurate, as this will guide us when fulfilling your order.

BASIS OF SALE

- Quotations are valid for 30 calendar days from the date of issue.

- Cake sizes are provided in inches and are based on the cake's diameter.

- No contract is finalised until we have received your booking fee. Once the fee is received, you are in a legally binding contract with The Ginger Bear Bakery.

THE CAKES

- We guarantee that, upon delivery or collection, the cakes will conform to the description in the order confirmation, meet satisfactory quality, and comply with UK food safety regulations.

- We are not responsible for customer dissatisfaction regarding design interpretation, provided the cake adheres to the pre-agreed order confirmation.

- The customer is responsible for ensuring all details in the order confirmation are correct.

- The warranty does not cover defects caused by willful damage, accidents, negligence, improper use, failure to follow instructions, or alterations made by the customer or third parties.

- Cakes are made in an environment containing nuts, eggs, milk, gluten, and other allergens. We cannot guarantee any cake is entirely nut-free.

- Fresh flowers are not included in the price of wedding cake designs. If you wish to use fresh flowers, your florist must provide them. **Note:** Some flowers are toxic and unsuitable for cake decoration; consult your florist.

- We recommend your florist liaise directly with us to ensure proper decoration without miscommunication.

- Occasionally, certain materials may become unavailable. In such cases, we will replace them with similar items of equal or better quality.

- Stacked cakes contain dowels for support. These must be removed before consumption.

DELIVERY AND COLLECTION

- For wedding cakes, we will coordinate with the venue to arrange a delivery time.

- If we set up the cake at the venue, we will photograph the cake before leaving and, when possible, obtain a signature confirming it arrived in good condition.

- Once delivered, we are not responsible for any damage or failure to follow instructions.

- If a cake stand or spacer is used, a security deposit is required, which will be refunded once the stand/spacer is returned in good, clean condition within three days of the wedding.

PRICE AND PAYMENT

- Booking fees are non-refundable and non-transferable.

- Payment for occasion cakes must be made at least seven days before collection, and for wedding cakes, at least four weeks prior to the wedding date.

CANCELLATION, POSTPONEMENT & ALTERATIONS

- In the event of cancellation by the customer, the following charges apply:

- Any payments made are non-refundable.

- For postponements, the payment remains the same as for cancellations, but subject to availability, we will transfer the payment to the new date (this can only be done once).

- You may amend or cancel your order by providing written notice eight weeks prior to the wedding or four weeks prior for other cakes.

- After this time, changes may not result in a reduction in price, even if the new design is cheaper.

WEDDING CAKES - ADDITIONAL TERMS

- Cancellation charges for wedding cakes are as follows:

- More than 90 days before the wedding: Booking fee only.

- 90 days to one month before the wedding: Booking fee + 50% of the remaining cost.

- Less than one month before the wedding: Full payment required.

- If you postpone, the payment remains the same as a cancellation. Subject to availability, we will carry the payment forward once. Any further postponements will be treated as cancellations.

- If the postponement exceeds 12 months, a new quote will be required.

- In the unlikely event that we need to cancel your order, all payments made will be refunded.

- The Ginger Bear Bakery reserves the right to cancel or suspend this contract due to force majeure events (e.g., fire, floods, strikes, or any other circumstances beyond our control). We will not be liable for any breach of contract due to such events.

COMPLAINTS

- Complaints are rare and taken seriously.

- Both parties agree not to post negative information online without first attempting to resolve issues privately.

- Decoration complaints should be raised upon delivery/collection so that corrections can be made. Once payment is made, the decoration is considered accepted, and no further claims can be made.

- Wedding cake clients will receive a detailed sketch of their cake. It is the client’s responsibility to ensure this meets their requirements.

- Quality complaints must be reported within 48 hours of delivery/collection, and the cake (or remaining portion) returned for assessment.

- Complaints will only be dealt with by the person who placed the original order.

GENERAL TERMS

- All designs and intellectual property remain the property of The Ginger Bear Bakery.

- We reserve the right to use images of your cake for advertising, including online promotions, brochures, galleries, and competitions.
